A writ is a formal legal instrument issued by a court, commanding an individual or authority to perform or refrain from performing a specific act. In the context of Bangladesh, writs serve as a crucial mechanism for safeguarding constitutional and legal rights, particularly when such rights are infringed upon by public authorities. The authority to issue writs is vested in the High Court Division of the Supreme Court under Article 102 of the Constitution of Bangladesh, which empowers the court to provide remedies in cases of unlawful actions or inactions by public bodies, especially where fundamental rights are at stake. The overarching purpose of these writs is to uphold the rule of law, ensure accountability of public institutions, and provide citizens with direct access to justice when their rights are violated. As such, writ jurisdiction forms a foundational element of constitutional governance and judicial oversight in Bangladesh. There are five principal types of writs recognized under Bangladeshi constitutional law: 1. Habeas Corpus The term Habeas Corpus literally means “produce the body.” It is a legal writ used to challenge unlawful arrest or detention. This writ serves as a safeguard against arbitrary deprivation of liberty by ensuring that a detained individual is brought before a court to determine the legality of the detention. For instance, if a person is arrested without a valid legal basis or not presented before a magistrate within 24 hours as required by law, a writ of habeas corpus may be filed. This writ can be initiated by the detained individual, a family member, or even a concerned friend, and is typically directed against the police or any authority responsible for the detention. 2. Mandamus The term Mandamus, meaning “We order,” refers to a judicial writ that compels a public authority to perform a duty that is legally required of them. It is typically invoked when a government official fails to carry out their responsibilities despite being obligated to do so by law. Only the person directly affected or aggrieved by such inaction is eligible to file a writ of mandamus. For example, if an individual has completed all necessary procedures to obtain a license but the responsible officer unjustifiably refuses to issue it, the individual may seek relief through this writ. Mandamus may be issued against government officials, public authorities, or statutory bodies that neglect or refuse to fulfill their legal duties. 3. Prohibition The term Prohibition refers to a judicial writ that means “to stop” or “to forbid.” It is issued by a higher court, typically the High Court Division, to prevent a lower court or tribunal from proceeding with a case that falls outside its lawful jurisdiction. This writ serves to restrain quasi-judicial bodies or subordinate courts from exceeding their legal authority. For example, if a tribunal initiates proceedings in a matter it is not legally empowered to handle, the High Court may intervene by issuing a writ of prohibition. Any person who is directly affected or aggrieved by such unauthorized action may file this writ to halt the proceedings. 4. Certiorari The term Certiorari means “to correct a mistake,” and refers to a judicial writ issued by a higher court to review and nullify decisions made by a lower court or tribunal that acted beyond its lawful authority. This writ is primarily used to ensure that subordinate courts do not exceed their jurisdiction or violate legal procedures. For instance, if a lower court imposes a punishment without having the legal power to do so, the High Court may intervene and cancel that decision through a writ of certiorari. Any person who is directly affected or aggrieved by such unlawful action may file this writ against the concerned lower court or tribunal. 5. Quo Warranto The term Quo Warranto, meaning “By what authority,” refers to a judicial writ that challenges the legal right of a person to hold a public office. It is used to question whether an individual occupying a government position has the lawful qualifications or authority to do so. For example, if someone assumes the role of chairman without meeting the required legal criteria, the court may issue a writ of quo warranto to remove that individual from office. Any member of the public may file this writ against a person who is unlawfully holding a government post.
