GR Case

A G.R case, or General Registrar case, refers to a criminal case filed at a police station under the provisions of Section 154 of the Code of Criminal Procedure, 1898. This process begins when an informant lodges a First Information Report (FIR) at the nearest police station. The Officer-in-Charge (OC) is responsible for receiving the FIR, which may be submitted in writing or dictated by the informant. The OC records the information using BP Form No. 27.

Once the FIR is filed, the case is forwarded to the Magistrate. The Magistrate examines the submitted documents and assigns a case number, officially registering it as a G.R case in the court’s General Register. There is no statutory time limit for filing a criminal case. However, if there is any delay in lodging the FIR, the reason for the delay must be clearly stated in the complaint.

CR Case C.R case, or Complaint Registrar case, refers to a criminal proceeding initiated through a formal complaint. The person who files a C.R case is known as the complainant. Such cases can be filed before the Chief Metropolitan Magistrate, Metropolitan Magistrate, Magistrate of the First Class, or any specially empowered Magistrate. According to the legal precedent set in 10 DLR 152, a Magistrate may take cognizance of a case based on a police report.

A Magistrate can take up a C.R case from three sources: (1) Based on a police report; (2) Based on a written complaint submitted by a person; and (3) Suo moto, meaning on the Magistrate’s own initiative based on personal knowledge or suspicion. Once a C.R case is accepted, the Magistrate conducts an inquiry to determine whether there is sufficient ground to proceed with the case.

Non-GR Case

When a police officer files a case as the plaintiff himself, it is referred to as a Non-G.R case. In such instances, the provisions of Section 103 of the Code of Criminal Procedure, 1898 are followed. This type of case is typically initiated directly by the police without an external complainant, and it does not go through the General Register process like G.R cases.

Non-FIR Case

If a person files a General Diary (GD) at a police station and the incident described in the GD subsequently occurs, it is treated as a non-FIR case. In such situations, the police may proceed with action based on the GD entry, but it does not follow the formal FIR process unless further legal steps are taken.

Dying Declaration

If a person makes a statement about the cause of their death before dying, it is considered a dying declaration, which may be treated as evidence in a legal proceeding. If the person had filed a General Diary (GD) at the police station and later dies, the contents of that GD may be considered as their dying declaration, depending on the circumstances and judicial interpretation.
