According to Section 172 of the Code of Criminal Procedure, 1898, every police officer conducting an investigation is required to maintain a police diary. This diary serves as a daily record of the investigation and must include the following four essential details:
The police diary is considered a crucial piece of documentary evidence. It must be kept securely locked at all times, and under no circumstances can it be shown to the accused. Moreover, no individual is permitted to view its contents and only the court has the authority to summon the diary to assist in inquiry or trial proceedings.
Importantly, neither the accused nor their legal representative can demand access to the diary, even if the court refers to it. However, if the police officer uses the diary to refresh his memory, the court may use its contents to challenge or contradict his statement, as per Section 161 of the Evidence Act, 1872.
