The separation of powers is a foundational principle in constitutional law that advocates for dividing the functions of government among distinct branches. A well-functioning government typically operates through three main organs: the legislative, executive, and judiciary. This division is designed to prevent the concentration of power and to safeguard individual liberty. By assigning specific responsibilities to each branch and ensuring they operate independently, the doctrine aims to prevent any single entity or group from monopolizing governmental authority with mechanisms of checks and balances to maintain accountability and prevent overreach.
The legislative branch is responsible for enacting laws, while the executive branch is tasked with implementing and enforcing them. Separately, the judicial branch interprets laws and adjudicates disputes, ensuring that legal interpretations remain consistent and just.
The doctrine of separation of power was formally introduced by Baron de Montesquieu in his 1748 work, The Spirit of the Laws. Montesquieu argued that liberty is best preserved when the legislative, executive, and judicial powers are held by separate institutions. Following the British constitutional system, his model aimed to prevent the abuse of power by promoting institutional independence. He was concerned that combining these powers within a single body could lead to arbitrary rule and instability. Montesquieu’s theory emphasized equality among institutions rather than individuals and sought to eliminate corruption by clearly delineating the functions of rule-making, rule-enforcing, and rule-adjudicating.
The Constitution of Bangladesh incorporates the doctrine of separation of powers by establishing the legislature, executive, and judiciary as distinct branches of government. While the judiciary is constitutionally independent, practical overlaps exist among the branches due to the complexities of governance. These overlaps are often necessary to ensure effective coordination and the functioning of checks and balances. Nonetheless, each branch is expected to respect the autonomy of the others, maintaining the integrity of the constitutional framework and promoting good governance.
The Spirit of the Laws-এ।
