The Doctrine of Necessity is a legal principle that permits actions which would otherwise be illegal or unconstitutional, if such actions are required to preserve the stability, order, or functioning of the state. It is invoked in exceptional circumstances where adherence to strict legal norms may result in greater harm or disruption. The doctrine essentially justifies the suspension or deviation from legal procedures in the interest of public necessity or national interest. For example, in constitutional law, courts have occasionally upheld extra-constitutional measures, such as the validation of a military takeover or emergency rule on the grounds that they were necessary to prevent chaos or collapse of governance. While controversial, the doctrine has been used in various jurisdictions to legitimize actions taken during crises, provided they are temporary and aimed at restoring constitutional order.
